Terms of use

Version 2026-10-17. Last updated 23 October 2026. The same terms are in the app: Settings → About and help.

About these terms

Roadside is a free driving and road safety app for Bermuda, published by Atlantic Strategies Ltd., a company in Bermuda ("we", "us"). These terms are an agreement between you and Atlantic Strategies Ltd.

By tapping Agree and continue, or by using Roadside, you agree to these terms and to the privacy policy, which explains what we collect and why. If you do not agree, do not use Roadside.

Driving safely comes first

You are responsible for how you drive. Always obey the law and the rules of the road in Bermuda, including the Bermuda Road Code, speed limits, road signs, signals, markings and the directions of police officers. They always take priority over anything Roadside shows or says. If Roadside says something different from a sign, a signal, a police officer or the law, follow the sign, the signal, the officer and the law.

Do not hold, handle or look at your phone while driving or riding. Set your destination before you move off, keep the phone in a fixed mount, use the spoken alerts and hands-free features, and let a passenger use the app when you need to change anything. If you need to use the phone, pull over safely and stop first, somewhere safe and legal. Using a handheld device while driving is an offence in Bermuda.

Keep your eyes on the road. Do not let the app distract you. Never drive while impaired or tired.

Reports come from other users and may be wrong. Hazards, traffic, closures and other reports are sent by drivers and riders and are not checked before they appear. They can be late, inaccurate, incomplete, already cleared or false. We may remove reports afterwards, but cannot check each one.

There is no guarantee of accuracy. Maps, directions, travel times, traffic, speed limits, camera locations, places, opening hours, weather and road notices may be incomplete, inaccurate, out of date or unavailable. Roads change and the map can be behind. Use your own judgment at all times, follow what you see on the road and drive to the conditions.

The speed warning is advisory only. The speed shown comes from your phone's GPS and can be wrong, and the limit shown comes from map data and can be wrong or missing. The posted limit and your vehicle's speedometer are what count. No warning does not mean you are within the limit.

In an emergency, call 911. Roadside is not an emergency service.

Who can use Roadside

You may use Roadside if you are old enough to make a binding agreement under Bermuda law, or with the permission of a parent or guardian. If you drive or ride, you must hold a valid licence and follow Bermuda's road traffic laws.

Roadside is made for use in Bermuda. Features may not work, or may not be allowed, elsewhere.

Your account

When you agree to these terms, Roadside gives your phone an anonymous account and a random device ID. We do not ask for your name, email address or phone number. You are responsible for what is sent from your phone through Roadside.

Reports, photos and notes you send

Only report what you believe is true, about the road and not about a person. Do not include names, phone numbers, number plates or faces that identify someone. Do not send anything offensive, unlawful or that you do not have the right to share. Do not report from the driver's seat while moving.

You keep any rights you have in what you send. You give Atlantic Strategies Ltd. a worldwide, non-exclusive, royalty-free licence to store, use, show, adapt (for example resize, combine or summarise) and share it as part of Roadside and of anonymous road information made from it. You confirm you have the right to give this licence.

We may refuse, hide, edit or remove any report, and limit or suspend an account that sends false or abusive reports.

Things you must not do

Do not use Roadside to break the law, to track, follow or harass anyone, or to share another person's location without their agreement.

Do not send false reports or votes, use scripts, automated clients or modified apps, or try to get around rate limits, checks or security.

Do not interfere with, overload or attack Roadside, its servers or other users.

Do not copy, scrape, sell, rent, redistribute or republish Roadside or its data, and do not reverse engineer, decompile or disassemble the app, except where the law allows it despite this term.

Share my ETA

When you share your ETA, anyone with the link can see your destination name, your arrival time and your approximate position (to about 200 metres, with the road and parish) until the share ends. Only send the link to people you trust.

The share ends when you arrive, when you stop sharing, when you end the route, after 20 minutes without an update, or after 3 hours at most. You can stop sharing at any time; if your phone is offline, the app shows Stopping… and keeps trying until our server confirms, and until then the link can show your last position for up to 20 minutes after the last update. The privacy policy explains what is kept and for how long.

Our rights

Roadside, its software, design and text, and the Roadside name are owned by or licensed to Atlantic Strategies Ltd. © 2026 Atlantic Strategies Ltd. All rights reserved.

We give you a personal, non-exclusive, non-transferable licence, which we may withdraw, to use the app on devices you own or control, for your own non-commercial use, under these terms and the rules of the store you got it from.

Other people's data and services

Roadside uses map data and software from others under their own licences. The credits and licences are in the app under About and help, then Legal notices. Information that comes from others may lag behind its source.

Some features use services run by others, such as the companies that host Roadside's services, Apple's Siri and CarPlay, and the app stores. Their own terms apply to them, and we are not responsible for them.

The service can change

Roadside is free. We may change, suspend or stop any part of it at any time, including for safety, legal or cost reasons. We do not promise that it will always be available or work without errors.

No warranty

Roadside is provided "as is" and "as available". To the fullest extent the law allows, we give no promise or warranty of any kind, express or implied, including that it is accurate, complete, reliable, available or fit for a particular purpose.

Limits on our liability

To the fullest extent Bermuda law allows, Atlantic Strategies Ltd. and its directors, staff and contractors are not liable for any loss or damage that comes from your use of Roadside or reliance on its information, including accidents, injury, fines, penalties, damage to vehicles or property, delay, or loss of data, whether in contract, tort (including negligence) or otherwise.

Where our liability cannot be excluded but can be limited, it is limited to 100 Bermuda dollars in total.

Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud, or for death or personal injury caused by negligence.

Your responsibility to us

If someone makes a claim against us because of what you sent through Roadside or because you broke these terms or the law, you agree to cover our reasonable losses and costs, to the extent the law allows.

Ending

You can stop using Roadside at any time. Delete my data, in Settings, removes your account. We may suspend or end your use of Roadside if you break these terms. The parts of these terms that by their nature should continue, such as the limits on our liability, continue after that.

Changes to these terms

We may update these terms. When a change matters, the app shows the agree step again and you can read the new terms before you continue. If you do not agree, stop using Roadside and use Delete my data.

Apple

If you got Roadside from Apple's App Store: these terms are between you and Atlantic Strategies Ltd., not Apple. Apple is not responsible for Roadside or its content and has no duty to provide maintenance or support for it. Roadside is free; Apple has no warranty obligation for it. Apple is not responsible for any claim about Roadside, including product liability, legal or regulatory compliance and consumer protection claims, or claims that Roadside infringes someone's intellectual property; we are, as far as these terms say.

You confirm that you are not in a country subject to a United States government embargo or listed as a terrorist-supporting country, and that you are not on a United States government list of prohibited or restricted parties. You must also follow the terms of any other service you use with Roadside. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Law and courts

These terms are governed by the laws of Bermuda. The courts of Bermuda have exclusive jurisdiction over any dispute about them or about Roadside, except where the law gives you a right to go to another court.

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. These terms and the privacy policy are the whole agreement between you and us about Roadside. You may not transfer your rights under them; we may transfer ours to whoever takes over Roadside.
